Prevention of Commercial Sexual Exploitation of Children as a Pedagogical Problem

The thesis analyses subject matter of commercial sexual exploitation of children and its prevention in school and families. Theoretical part focuses on explanation of terms. It also covers description of presence of the subject in the Czech Republic, legislation and its relationship to the prevention in school and family. Prevention programs are introduced in this thesis as well. The prevention subject has been surveyed through a questionnaire and outcomes were confronted with a hypothesis. At the end of the thesis is pronounced solution that might help pedagogues with subject prevention. Psychological aspects of interviewing in criminal prosecution

1 Abstract The present work deals with interviews with the child witnesses and its results in the form of testimony. Mapping the developmental specifics of children relevant in the course of interrogation. We also offer an overview of specific procedures which take account of claims arising from working with this group of witnesses. The main emphasis is put on the method of cognitive interview created by Geiselman and Fisher (1992) and its possible use in children. The practical part is flush pays overview suitability of specific methods - cognitive interview for the purpose of the interview with preschoolers. The second level maps the development specific manifestations of children during the interview follows. By analyzing 20 interviews to identify specifics manifest both in the cognitive area, as well as in social skills and capture their concrete form. The subsequent step were testimonies by children assessed in terms of the methods used. On a given sample but it turned out qualitative and quantitative differences in content of the statement in the respective phases. Using as ideal for obtaining accurate and detailed testimony shows Open-ended narration of phase combination and Phase probing memory codes. Specificity of interrogation of children

The aim of the thesis was to describe the main differencies between an interrogation of adults and children. The thesis is composed of six chapters, an introduction and a conclusion. The first chapter is focused on concept "a child" in the Czech legal order and International agreements. The next chapter describes specifics and problems of individual evolutionary periods of children. The third chapter explains the interrogation in a general meaning. The interrogation is included and modified in more statutes. I focused on provisions of a statute relating the interrogation in Czech law, especially in criminal law. Next part of this chapter deals with the interrogation and a criminalistics. How to prepare for the interrogation, the stages of the interrogation and tactics of its implementation. I also mentioned the forensic psychology which helps and supplements the criminalistics with its own methods and findings. The fourth chapter is an analysis of a testimony, in a first part in general meaning and the second part describes a process of formation of the testimony and the factors which can influence this process from an event to a record by an interrogator. This diploma thesis focuses on the matters of children interrogation -specifically persons younger than 15 years being in position of victims or witnesses of crime. Even though I narrowed down the topic of the thesis, it is certainly very broad and complicated one which can be discussed more in depth. Children interrogation usually requires extensive efforts of the interrogating person - patience and empathy above all. Also, previous experience and the understanding that each case is individual and each child has to be apporached in a different way, are crucial. The interrogating's objective is to find out the relevant information and prevent secondary victimisation of the child at the same time. Diploma thesis contains two parts - theoretical and practical. Theoretical part is focused on Czech legal regulations related to these matters, specifics of child personality (ontogenesis, temperament and child character) and methods of interrogation (analyses single stages of the interrogation, deposition, documentation, persons taking part in the interrogation and possible mistakes which can be made). The aim of the diploma thesis is to determine the issue of a child interrogation as a crime victim. The reason for my research is the fact that despite of all the Criminal Procedure amendments the methodology of systematic child interrogation and its real usage is still not properly defined. The thesis is composed of four chapters, each of them dealing with different aspects of sexual abuse of the child's interrogation. Chapter One is introductory and the chapter is subdivided into four parts. Part One and Part Two contain a short historical excursion define sexual abuse terminology and its forms. Part Three deals with Child Abuse and Neglect Syndrome and its five categories. Part Four is concerned with an occurrence of the Sexual abuse phenomenon in the Czech Republic, latency and status of educational institutions. Chapter Two examines relevant Czech legislation and European Union. First and second part characterise a statutory offence in Penal Code.
